#KilmarAbregoGarcia’s case was both a human tragedy & an incipient #ConstitutionalCrisis. His Kafkaesque predicament is a stark illustration of what it means to be stripped of the #law’s protection, & thus a warning for us all.

But Abrego Garcia is not alone.

That’s in some tension with the result: that they were sent to a prison that is neither in the #US nor their country of origin with NO CHARGES & no clear #legal #authority justifying their continued, indefinite detention. The US govt is paying #ElSalvador to hold them.

The cases present a kafkaesque situation. The govt did not remove these #Venezuelans under the wartime #AlienEnemiesAct, which the #Trump admin argued allowed it to send people to #CECOT absent #DueProcess, an argument #SCOTUS would later reject. Rather, the admin has contended in court filings that these individuals were sent to #ElSalvador under the #Immigration & Nationality Act [#INA].

That, at least, is what federal ofcls contend: while the #Trump admin invoked the #AlienEnemiesAct to dubiously justify sending 137 detainees to #ElSalvador, >100 others that day had received standard, *lawful* #deportation orders—often to Venezuela—from #immigration courts.

Judge #Xinis postponed discovery in the #KilmarAbregoGarcia case for 1 week until April 30, 2025, at 5:00 PM, w/agreement from both sides. The reason is unclear but it follows a sealed filing from the #Trump admin yesterday.

Leaders of elite private institutions that have been repeatedly targeted by #Trump were among the signers.
“We are open to constructive reform & do not oppose legitimate government oversight. However, we must oppose undue #GovernmentIntrusion in the lives of those who learn, live, & work on our campuses,” the letter, released by the American Assoc of #Colleges & #Universities, said.

In a letter to Harvard earlier this month, the #Trump admin had called for broad govt & leadership reforms at #Harvard as well as changes to its admissions policies. It also demanded that the #university audit views of diversity on campus, & stop recognizing some student clubs.

Harvard President Alan Garber said the university would not bend to the govt’s demands. Hours later, Trump froze billions of dollars in federal funding.

Senator Chris #VanHollen, the Maryland Democrat who traveled to #ElSalvador last week & met with #KilmarAbregoGarcia, a man from his state who was wrongfully deported by the #Trump admin, said on CNN that Trump “is trying to change the subject” by claiming the man,, is a member of the MS-13 gang. He said Trump is “outright defying” #SCOTUS’ order to facilitate Abrego Garcia’s return.

Some of the proposed changes outlined in the document would require congressional notification & no doubt be challenged by lawmakers, including mass closures of diplomatic missions & headquarters bureaus, as well as an overhaul of the diplomatic corps. Substantial parts of it, if officials tried to enact them, would likely face lawsuits.

Harsono met his future wife in 2022 while studying for his MBA, & they married the next year. They now have an 8-month-old daughter, Adalet, who recently learned how to say “da da” during calls with her jailed father.

“I just wanna kiss my wife on her forehead, & hold my daughter as tight as I can,” Harsono said Wednesday night. “I wanna be there for my daughter.”

On April 16, 2021, Harsono joined about 1k people demonstrating over #GeorgeFloyd’s murder by Minneapolis #police & the recent death of #DaunteWright by police in Brooklyn Center.

He was arrested for unlawful #assembly after the #protest, though the charge was dismissed. His wife & attorney said agents & lawyers cited Harsono’s protest history during detention proceedings.

“The MNA Board of Directors reaffirms their position that nurses should not & will not serve any role in immigration enforcement,” the association said in a statement.

The group said its directors hope all hospital employees reject assisting #ICE.
