Die Antwort gibt § 45 StGB: </p><p>Wer wegen eines Verbrechens (Definition am Ende des Tröts) zu mind. 1 Jahr Freiheitsstrafe verurteilt wird, verliert die Wählbarkeit für 5 Jahre automatisch. </p><p>Wenn wegen bestimmter anderer Taten (bei denen das im Gesetz vorgesehen ist) zu - je nach Delikt - mind. 6 Monaten oder 1 Jahr Freiheitsstrafe verurteilt wird, kann das Gericht den Verlust der Wählbarkeit im Einzelfall anordnen. Hier geht um Mitgliedschaft in einer terroristischen Vereinigung, Sabotage oder auch Delikte, die mit Bezug auf ein öffentliches Amt verübt wurden (z.B. Bestechung, Rechtsbeugung, Körperverletzung im Amt, Aussageerpressung etc.). </p><p>Aber: anders als bei Le Pen könnte bei uns nicht angeordnet werden, dass die Wirkung schon vor Rechtskraft eintritt, also noch während die Berufung oder Revision läuft. <br>Dafür würde bei uns Le Pen ihre bereits vorhandenen Ämter und Mandate mit der Rechtskraft dann ggfl. verlieren. </p><p>Übrigens: wer zu mehr als 1 Jahr Freiheitsstrafe verurteilt wird, verliert automatisch auch eine evtl. vorhandene Beamtenstellung. </p><p>Im Strafrecht gibt es (leichtere) <a href="https://xn--baw-joa.social/tags/Vergehen" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Vergehen</span></a> und (schwerere) <a href="https://xn--baw-joa.social/tags/Verbrechen" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>Verbrechen</span></a>. <br>Von Verbrechen spricht man dann, wenn die Mindeststrafe 1 Jahr Freiheitsentziehung oder mehr beträgt. <br>Leider wird es dann ein bisschen verwirrend: es kann minder schwere Fälle geben, bei denen die Strafe auch niedriger ausfallen kann. <br>Und natürlich kann man zu mehr als 1 Jahr auch wegen eines Vergehens verurteilt werden, für das als Mindeststrafe nur Geldstrafe oder eine Freiheitsstrafe von weniger als 1 Jahr angedroht wird. <br>Warum so kompliziert? Weil man dem Einzelfall gerecht werden möchte.
